LIABILITY WAIVER, PHOTO RELEASE, AND INDEMNITY AGREEMENT
By signing up for the Kid’s Classes through the sign up form and checking the box that allows you to submit the form, you confirm your understanding and acceptance of the following terms and conditions:
- Assumption of Risk: You understand and acknowledge that participation in Vice Outdoors LLC’s (“Company”) Introduction to Fly Fishing Class (the “Class”) involves inherent risks, including the risk of personal injury. You voluntarily assume all such risks and accept personal responsibility for any damages following such injury, permanent disability, or death.
- Release and Indemnity: You release, waive, discharge and covenant not to sue the Company, its directors, officers, employees, sponsors, advertisers, and, if applicable, owners and lessors of the premises used to conduct the Class (collectively, the “Releasees”) from all liability, claims, demands, losses, or damages on your account caused or alleged to be caused, in whole or in part, by the negligence of the Releasees or otherwise.
- Photo Release: You grant to the Company and its representatives the irrevocable right to take and use photographs and/or video recordings of you from the Class for promotional, advertising, and informational purposes in any media. You waive any rights to compensation or approval rights. This photo release applies only to photographs taken during the Class, and does not apply to any other photographs or recordings.
Please note, if the participant is under 18, a parent or guardian must agree to these terms on their behalf.
